TERMS AND CONDITIONS OF THE LOYALTY PROGRAM AND INFORMATION ON THE PROCESSING OF PERSONAL DATA

 

The Loyalty Program has been created by the company " O-BIOTIQUE " located at 3-5 Sorou Street, Maroussi 151 25, Greece. It is addressed to adult customers of O-BIOTIQUE stores and the e-shop obiotique.com and concerns the recording and analysis of the purchases they make as members of the Program. The purpose of the Loyalty Program is, on the one hand, to reward with points and privileges O-BIOTIQUE customers who choose O-BIOTIQUE stores for their purchases and to provide them with preferential information about O-BIOTIQUE products and services and, on the other hand, to record, analyze and research the purchasing tendencies of O-BIOTIQUE customers (product categories chosen, traffic, type of products chosen by customers, response to general and special offers, etc.). etc.), in order to improve the management of its customer base and the provision of products and services that best suit its customer base.

  1. REGISTER FOR THE PROGRAM

- Registration for the Programme is carried out electronically on the website of the e-shop obiotique.com

- Registration to the Program via the obiotique.com website, the member is directed to a form to fill in the details in order to complete his/her registration in the Loyalty Program and start enjoying the benefits of the Program. 

  1. REDEMPTION OF POINTS

- Anyone who has reached the age of 18 is eligible to enroll in the Loyalty Program.

- By accepting these terms and conditions of the Program, the member agrees to receive informative and/or promotional messages from O-BIOTIQUE

- Upon enrollment in the Loyalty Program, member acknowledges that membership is strictly personal. The transfer of earned points in any way is prohibited.

- The member is entitled for benefits on purchases in the online store obiotique.com and to redeem his/her points.

- The member's obligation in order to earn or redeem points is to be a member of the Loyalty Program, and to have logged into his/her account when making online purchases at the obiotique.com online store

- The member is entitled to 1 point for every 1€ of purchases for obiotique.com transactions

- For every 1,000 points redeemed, the member receives a €10 e-coupon.

- The member can view his/her available points and coupons through his/her Loyalty Program account at obiotique.com.

- Only one (1) e-coupon may be redeemed per transaction.

- Each time a member redeems points corresponding to a discount coupon, the same number of points shall be deducted from the member's available points balance. The discount is not exchangeable for cash. To qualify for the corresponding discount, the member must make purchases of equal or greater value.

- The points acquired by the member are valid indefiniteyl from the date of the relevant transaction on the basis of which they were acquired or the date of the promotion from which they were acquired. Members will be informed at any time of the total number of active points they have accumulated from their purchases and/or from promotional actions in the following ways: a) through their account on obiotique.com and b) by email at rewards@obiotique.com and, if desired, through the member service line by calling +30 210 6199781 (Monday - Friday from 9:00 - 17:00).

- Once the member redeems his/her points for e-coupons, the validity period of each voucher is 3 months from the day of redemption and can be used on purchases of equal or greater value. If the validity period of the coupon expires, the coupon expires and is lost and the points are not refundable to the member.

- In the event that the member returns all or part of the products purchased and from which he/she earned points, then the points corresponding to the amount of the return will be deducted from his/her account, subject to a refund.

- The member declares that any information contained in the form for filling in his/her details is true and accurate and is responsible for its correctness. O-BIOTIQUE is not responsible for the return of Membership Benefits in the event that the Member has provided incorrect or inaccurate personal information.

  1. MODIFICATION - TERMINATION - TERMINATION

- O-BIOTIQUE is entitled to unilaterally modify any term of this Agreement, including the method of calculation of points and the amount of purchase rewards. Any such modification will be notified to the Member by posting on obiotique.com which shall be deemed valid and sufficient notice to the Member.

- O-BIOTIQUE shall have the right to terminate at any time, without notice or reason, this Agreement with the Member or to prohibit the use and/or terminate the Loyalty Program at any time, without notice or reason, as this Program is a voluntary benefit of the Company.

- Should the Member fail to comply with these terms and conditions or in the event of misuse or attempted fraud through the membership, all points will be deleted and all benefits will be withdrawn and it is possible that the Member's data may be forwarded to the relevant authorities for processing.

- The membership will provide the holder with benefits for as long as the member is identified as a valid member of the Loyalty Program and for as long as the Loyalty Program is in force. O-BIOTIQUE reserves the right, in its absolute discretion, to vary this period of time.

- Should O-BIOTIQUE modify some or all of the terms and conditions of the Program or terminate the Loyalty Program, the participant shall have no claim against the Company, provided that the participant hereby acknowledges that this is a Loyalty Program provided at the Company's discretion.

- A member may request to be removed from the Loyalty Program

- b) by calling 2106199781

- c) via the contact form on obiotique.com

- Rejection/restriction of processing/deletion of data may mean termination of membership in accordance with 4.4 below.

 

  1. PRIVACY POLICY

The controller of the personal data processed in the context of the operation of the Loyalty Program the Company under the name "OBIOTIQUE IKE" and the distinctive title "O-BIOTIQUE", with VAT number: 800757312, D.O.Y. Maroussi, GEMI Number 139796101000, with the activity of "import, marketing, distribution and sale of cosmetics, food supplements and other related products aimed at improving or maintaining health and beauty" (hereinafter "Company" or "O-BIOTIQUE"). 4.1 Which Personal Data the Company collects and for what purposes:

The Company collects directly from you the data that you fill in the registration form for the Loyalty Program. Specifically, the personal data that each member must provide to register for the Loyalty Program is: First name, last name, address, Email, phone number and optionally, if the member wishes to receive special offers and gifts, the date of birth and date of nominal holiday.

The Company also collects data generated from the member's purchases, such as the categories of products purchased.

The member is informed that the Company does not collect or require the member to disclose special category personal data (sensitive personal data) for the purposes of the Program.

 

The Company processes the aforementioned data as well as the user account data in the e-shop for the following purposes:

  1. execution of the terms of the Loyalty Program,
  2. communication of general or special offers and/or gifts to the member and informing the member about its products and services,

- Provision of Loyalty Program Privileges and the analysis and research of its customers' purchasing trends (product categories chosen, footfall in the company's physical stores and eshop, product categories chosen by customers, response to general and special offers, etc.) in order to improve O-BIOTIQUE's management of its customer base and the provision of products and services that best suit its customer base,

- fulfilling OBIOTIQUE's obligations under the law, such as when the relevant data are requested by tax authorities in the context of audits or to serve its obligations and legitimate interests, such as in cases before regulatory, administrative or judicial authorities and to ensure that the member is an adult natural person and resident in Greece.

4.2 Legal Basis for Processing and Updating Data:

4.2.1 O-BIOTIQUE relies on the following legal bases for processing the data of the members of the Privilege Program:

- Performance of the contract: In order to achieve the purposes of this contract and the card, namely a) the participation of the member in the Program by recording and analyzing his/her purchases and rewarding the member with points and privileges from his/her purchases, b) informing the member about special offers and preferential services and c) the general analysis of the general purchasing trend of the members of the Program, it is necessary to process the personal data provided by the member upon enrollment in the Loyalty Program

- Legitimate Interests: O-BIOTIQUE reserves the right to process the personal data of members in order to improve its services and customer management, to promote its products, as well as to detect attempted fraud or misuse of the Program, any cooperation with judicial and regulatory authorities, as well as to safeguard and support the general legitimate interests of OBIOTIQUE

- O-BIOTIQUE also reserves the right to regularly inform the Member via telephone communication, e-mail, mobile phone message (SMS, WhatsApp, Viber) or any other appropriate means of communication he/she chooses in his/her contact details, legally acquired in the context of the registration in the Loyalty Program, about its products and services in the context of their transactional relationship (article 11 paragraph 3 of Law 3471/2006) and if the Member has not objected (opt-out) to this communication. This information may include preferential and specialised information on its products, special and/or general offers, promotions and competitions. O-BIOTIQUE may also communicate with the member via messaging services such as SMS,WhatsApp, Viber, etc. for better communication with members and control of communication costs.

The members will be used by O-BIOTIQUE to inform them or request the termination of commercial communication

  1. a) via the contact form of obiotique.com
  2. b) by sending an email to rewards@obiotique.com as well as by using the "Contact us" form on the "Contact us" form
  3. c) by phone call to the number +30 210 6199781

for technical reasons and that if he/she has objected to the commercial communication of O-BIOTIQUE, he/she will not be able to receive informative and promotional messages and offers for members. It is clarified that O-BIOTIQUE will continue to use the aforementioned communication channels for non-commercial communication with the Member regarding, in particular, the use of his/her card and the present terms and conditions.

4.2.2 The Member has both the right and the obligation to access, correct and update his/her personal data and must notify the Company without delay of any change in them.

Any possible change in the member's personal data may be made:

  1. a) to the email rewards@obiotique.com
  2. b) by telephone at +30 210 6199781 or

4.3 Recipients of personal data

For the data necessary to serve each of the above processing purposes and within the scope of the responsibilities of each recipient, the recipients of the member's data may be:

  1. The competent employees of O-BIOTIQUE.
  2. The competent authorities of O-O-BIOTIQUE shall be the competent officials of O-BIOTIQUE.
  3. The company which provides CRM services and which is responsible, among other things, for entering, updating, and maintaining the database of member data as the processor on behalf of O-BIOTIQUE and in accordance with its instructions and recorded instructions .
  4. to the extent appropriate for the fulfilment of our contractual obligations, to better serve you and to satisfy your requests, may be transmitted to providers affiliated with the Company, such as legal, consulting and auditing companies, IT companies, companies providing internet services, or other services necessary for the operation of the website and the performance of the Company's services

 

During the registration and processing of the member's personal data, O-BIOTIQUE's employees and contractors as well as all those performing the processing on behalf of O-BIOTIQUE fully comply with the provisions of the European General Regulation 2016/679 as well as with the applicable Greek legislation and case law on the protection of personal data, are contractually bound to comply with their obligations and are not allowed to use the personal data for their own commercial or other purposes, but only c

4.4 Data subject rights:

Each member, as a personal data subject, may exercise at any time his/her rights to his/her personal data processed by the Company in the context of the Loyalty Program, as provided for in the General Data Protection Regulation 679/2016 EU (in particular Articles 12 to 23 thereof) and national legislation and in particular:

  1. the right to information and access to personal data,
  2. the right to access to his/her personal data, 2. the right to restriction of the processing of his/her data,
  3. the right to rectification or erasure of some or all of his/her personal data,

 

  1. the right to object to the processing of his or her personal data; and
  2. the right to data portability, i.e. to request the transfer of his/her personal data to another controller in the format indicated by the competent supervisory authority.

 

In particular, the member may exercise the above rights as follows:

- by submitting a request to dpo@obiotique.com

- by writing to O-BIOTIQUE IKE at the following address: 3-5 Sorou Street, Maroussi 15125, Greece.

O-BIOTIQUE will take all possible measures to satisfy the member's request within (1) one month from the date of its valid submission and in case more time is required, it will inform the member accordingly. In this case, the Member is informed that it is likely that some minimally necessary of his/her personal data will be retained to safeguard the legitimate interests of O-BIOTIQUE.

It is clarified that in order for the exercise of the above rights to be considered valid, the identification of the member may be requested, in order to ensure that the personal data for which any of the above actions are requested actually belong to the member/individual requesting the specific action.

Also, the member may at any time request the cessation of sending commercial communications, in one or all of his/her contact details (SMS, WhatsApp, Viber ) on his/her mobile phone: 

  1. a) via the contact form of obiotique.com
  2. b) by sending an email to rewards@obiotique.com, and
  3. c) by phone call to the number +30 210 6199781.

The Member should also be aware that, due to the nature of the operation of the Loyalty Program, the exercise of any of the above rights, and in particular the right to oppose or restrict the processing and, partially or totally, delete the Member's data, will result in the termination of this contractual relationship and therefore of the Member's participation in the Loyalty Program and the deletion of the points collected within thirty (30) days from the submission of the relevant request, because without the processing of the Member's data, the Member's data will be deleted.

For any information regarding his/her personal data and their processing and protection, the Member may contact the Data Protection Officer (DPO) of O-BIOTIQUE at the email dpo@obiotique.com and if he/she does not consider himself/herself satisfied by the actions of O-BIOTIQUE, he/she is informed that he/she has the right to appeal to the Personal Data Protection Authority (Kifissia 1-3, P.C. 115 23, Athens) by filling in and submitting the online form at the link https://www.dpa.gr/el/polites/katagelia_stin_arxi.

4.5 Retention period of Personal Data:

The member's personal data will be retained by the Company until the member cancels the membership in the Program. However, some necessary personal data relating to the member's transactional relations with O-BIOTIQUE and the member's declarations regarding the processing of his/her data may remain as information about the member in O-BIOTIQUE's systems to ensure the proof of the legitimacy of the processing of his/her data by O-BIOTIQUE and to safeguard the parties' legal claims.

In case of , O-BIOTIQUE shall retain the Member's personal data for thirty (30) days from the day of deletion. However, the Member is informed that even after the expiration of these 30 days, O-BIOTIQUE will retain the fiscal data of his/her purchases, while some basic data of the Member will be retained, which will remain in its files to ensure the legality of their processing (e.g. his/her mobile phone number and e-mail address in encrypted form, the date of registration and deletion from the Loyalty Program), in order to safeguard the legitimate interests of O-BIOTIQUE.

The data collected as a result of your contact with O-BIOTIQUE, either through the online contact form on obiotique.com or by email or telephone, is retained by the Company's Customer Service Department and is anonymized for nine (9) months from the date of contact.

4.6 Technical and organizational protection measures:

O-BIOTIQUE the processors on its behalf and its contractors / fulfilment assistants shall implement appropriate technical and organisational measures to protect, as far as possible, personal data against accidental or unlawful destruction or loss, alteration, unlawful disclosure or access and generally unlawful processing (including remote access) as well as to ensure the possibility of restoring the availability and access to such data.

These measures are intended to ensure a level of security appropriate to the risk to which the data in question may be exposed, always taking into account the nature and criticality of the data, the technical capabilities of O-BIOTIQUE and its partners, the evolution of technology, the cost of implementation and the nature, scope, context and purposes of any particular processing, while implementing procedures for the regular testing, assessment and evaluation of the effectiveness of the technical and organisational measures in place to ensure the security of the data.

In any case, O-BIOTIQUE, its processors on behalf of O-BIOTIQUE and its contractors/assistants are contractually bound to maintain the confidentiality of members' personal data and not to disclose or allow access to it to any third party without the prior notification of the member, except in cases expressly provided for by law.

  1. OTHER TERMS

- O-BIOTIQUE shall not be liable for any damage, whether initial or consequential, positive or consequential, direct or indirect, to the Member from the use and application of the Loyalty Program. In any event, any liability of O-BIOTIQUE shall be limited solely to the re-crediting of any lost points on the Member's Loyalty Program account. O-BIOTIQUE shall not be liable for any damage to the Member, other members of the Program or third parties due to false or inaccurate statements made by the Member, in particular regarding the Member's personal details.

- These Terms constitute the sole and entire contractual document governing the relationship between O-BIOTIQUE and the members of the Privilege Program, supersede any prior versions thereof, and shall remain in effect until any subsequent modification by O-BIOTIQUE, which shall be effective either upon notification to members or upon posting on obiotique.com.

- The present Terms apply to members of the Loyalty Program in Greece and govern their relationship with O-BIOTIQUE as of 26/10/2023.They shall be interpreted in accordance with Greek Law and any interpretation or dispute between the member and O-BIOTIQUE shall be subject to the exclusive jurisdiction of the Courts of Athens.
